Can my father's Trust protect my assets?

demoQ - I am working on my father's trust and started transferring his assets as required.  I like the protection that's provided by his Trust, can I use his trust to protect my assets?  A - Once you have completed all the elements of the trust, including the transfer of assets, the trust is considered finished.  And no, unfortunately you cannot use your father's trust for your assets, but if your father's Trust was completed by us, you are eligible for our preferred client pricing, call us to find out more.

demoThe Health Insurance Portability and Accountability Act (HIPAA) provides protection for release of individually identifiable health information and special release and consent authority to all healthcare providers before medical information can be released.  HIPAA effects documents executed in a trust, as such, it is not grandfathered in which means that it can render executed documents of previous executed Living Trust useless.  Ensure your Living Trust is in compliance with these regulation.  All IntegriTas Living Trust are in compliance with the order. 


Who Contacts  the Survivors?

demoQ - My father died and I believe he had a trust.  Does the attorney contact me to discuss my dad's last requests?  I don't have the attorney's information and how does the attorney know that he is deceased?  A - Unless the attorney was a friend or the Trustee for your dad, its unlikely he would know that your father passed.  So first, you need to start checking around the house for the trust manual.  Did your dad have a safety-deposit box? Once you have located the manual, you can determine who is the Successor Trustee and who will carry out the provisions of your dad's trust.  If someone else has been named Successor Trustee, you will need to get in contact with that person to ensure they carry out the orders of the trust.

LaLisa Semrad, Attorney at Law

LaLisa Semrad attended college at the University of Oklahoma, graduating in 1997 with a Bachelors of Business Administration degree.  Upon graduation, she worked in accounting for a couple of years, until she returned back to the OU College of Law and received her Juris Doctor degree in 2002. Once she passed the bar examination and was admitted as a member of the Oklahoma Bar Association, LaLisa immediately opened her own private law practice.  Having concentrated her legal studies on estate planning and tax law, those areas became the main focus of her law firm.

In the last eight years, LaLisa has completed estate planning for hundreds of clients throughout Oklahoma.  She regularly attends continuing education courses to keep her knowledge current and believes that most heirs are better served when they receive an inheritance from a properly funded Trust, rather than through the state probate system.  LaLisa takes great pleasure in assisting her clients with their legal needs, and encourages individuals to plan for their family’s future.

Aside from her law practice, LaLisa serves on the membership board for Synergy Enterprise Development, one of the first small business incubators in the state, and has served as past president for the Cares Foundation in Oklahoma City.  She’s also involved with various other charitable organizations and enjoys spending time with her family.

Jim Hicks, Attorney at Law

pictureJames Hicks concentrates his practice in the areas of business litigation, family law, estate planning, probate and insolvency matters.  He is a member of the American, Oklahoma and the Tulsa County Bar Associations, having served in a several leadership positions in each organization.

Mr. Hicks was recently elected as Vice President of the Tulsa County Bar Association for the 2011-2012 year.  A former member of the Oklahoma Bar Association’s Board of Governors, and is a recipient of the Oklahoma Bar Association’s Outstanding Young Lawyer Award and the Tulsa County Bar Association’s President’s Award.  Mr. Hicks has maintained an “AV” rating from Martindale-Hubbell – a peer review attorney rating organization – for the last fifteen (15) years.  He has also been recognized as a “Super Lawyer” by Oklahoma magazine for the last several years.

Jim Hicks is a partner in the Law Firm of Morrel Saffa Craige, P.C., Mr. Hicks is active in several community organizations and is a past member of the Vestry of St. John’s Episcopal Church in Tulsa.
